Terms of Use

These Terms of Use ("Terms") govern your access to and use of BuddyGem (the mobile and web application published as Hiddenly).

This document is published at https://hiddenly.up.railway.app/terms-of-use. After editing this file, run npm run sync:terms-of-use --prefix backend/api (or copy to backend/api/assets/terms-of-use.md) before deploying the API. Have a qualified lawyer review it for your jurisdiction(s).

1. Who we are

Product: BuddyGem / Hiddenly — a community map for discovering, saving, and sharing interesting places, routes, and travel-related content.

2. Acceptance

By creating an account, signing in, or otherwise using Hiddenly, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

3. Eligibility

You must be at least the minimum age required in your country to consent to data processing (typically 13–16, depending on jurisdiction). If you use the service on behalf of an organization, you represent that you have authority to bind that organization.

4. Your account

• You are responsible for activity under your account and for keeping your sign-in credentials secure.
• Provide accurate profile information and do not impersonate others.
• We may suspend or terminate accounts that violate these Terms or harm the community.

5. Community content and conduct

Hiddenly is a community platform. With limited exceptions (such as curated reference data), places, descriptions, photos, reviews, ratings, routes, tips, links, coordinates, opening information, and other map-related content are submitted by users, not by us. We do not guarantee that any such content is accurate, complete, current, legal to access, safe to visit, or suitable for your purposes.

You retain ownership of content you submit, but grant us the licenses needed to operate the service (host, display, moderate, and share it as described in the Privacy Policy).

You agree not to:

• Post unlawful, harassing, hateful, or misleading content
• Upload content you do not have rights to use
• Scrape, reverse engineer, or overload the service without permission
• Use the service for spam or unauthorized commercial solicitation

We may remove content or restrict features to protect users and comply with law.

6. Third-party services

Maps, navigation, social links, and other integrations open third-party apps or websites with their own terms. We are not responsible for third-party services.

7. Intellectual property

Hiddenly's branding, software, and curated data structures are protected by applicable intellectual property laws. Do not copy or misuse our trademarks or app assets except as allowed by these Terms.

8. Disclaimers — places, travel, and user content

No duty to verify. We do not independently verify places, routes, access rules, safety conditions, or other user-submitted information. Displaying a pin, route, photo, or description does not mean we recommend, endorse, or guarantee that you should go there.

Your responsibility before visiting. Any decision to travel to, enter, or use a place shown in Hiddenly is entirely yours. Before visiting, you must independently research and confirm, including but not limited to:

• whether entry is permitted (public/private land, opening hours, tickets, reservations)
• local laws, regulations, and customs
• physical safety, terrain, weather, wildlife, and health risks
• whether a site is open, under construction, closed, or restricted
• suitability for your fitness, equipment, companions, and any minors in your care
• insurance, visas, and other travel requirements

No responsibility for visits. To the fullest extent permitted by law, we are not responsible for anything that happens when you visit, attempt to visit, or rely on a place or route from the app — including injury, death, property loss or damage, fines, detention, trespass, theft, accidents, getting lost, or any other harm or loss. Hiddenly is an information and discovery tool, not a guide, tour operator, navigator of last resort, or emergency service.

Routes and navigation. Suggested routes, directions, and links to third-party maps are provided for convenience only. Road conditions, closures, and local rules may differ. Follow official signage and lawful instructions on site.

"As is" service. The service is provided "as is" and "as available." Place information, routes, and community content may be incomplete, outdated, misleading, or wrong. Always verify important travel, safety, and access information through official and independent sources.

9. Limitation of liability

To the maximum extent permitted by law:

• we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from your use of the service;
• we are not liable for any harm, loss, or claim related to visiting or attempting to visit any place, following any route, or relying on any user-generated or third-party content in the app;
• our total liability for any claim relating to the service is limited to the greater of (a) the amount you paid us for the service in the 12 months before the claim, or (b) EUR 50, except where mandatory law does not allow such limits.

Some jurisdictions do not allow certain exclusions or limits; in those cases, our liability is limited to the minimum permitted by applicable law.

10. Changes

We may update these Terms from time to time. We will post the updated version at the URL above and update the "Last updated" date. Continued use after changes means you accept the revised Terms.

11. Termination

You may stop using Hiddenly at any time and may request account deletion in Settings → Manage my data. We may suspend or terminate access if you breach these Terms or if required by law.

12. Governing law

These Terms are governed by the laws of Poland, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country provide otherwise.
